Emissions Trading: The German Allocation Plan
Emission Trading in Germany is gathering momentum. A draft emission trading act, transposing the EC Emission Trading Directive of 13 October 2003 (2003/87/EG) was presented in December 2003.
On 29 January 2004, a first draft of the National Allocation Plan was published. The article gives an overview of the German plan, reveals possible distortions of competition that emanate from different allocation criteria in various Member States and also analyses whether and what kind of legal action is possible against it.
