Emissions Trading in Germany
On 17 December 2003 the German Cabinet adopted the German Emissions Trading Act and the Ordinance implementing Directive 2003/87/EC for Installations pursuant to the Federal Immissions Protection Act.
Both legal instruments transpose Directive 2003/87/EC establishing a scheme for greenhouse gas emission allowance trading within the Community and amending Council Directive 96/61/EC in national law and thus set out the legal framework for an emissions trading system in Germany. In the following article, the core provisions of these legal instruments and its further development will be explained in its context taking into account, in particular, legal questions that arise when developing an emissions trading system in Germany.
