Klimaschutz im Beihilfenrecht – Die CEEAG-Leitlinien und die AGVO-Novelle
The European Union's climate targets require a comprehensive transformation of the economic and legal framework. State aid is an important instrument for promoting climate policy goals, but is caught between the prohibition of state aid pursuant to Article 107 (1) TFEU and the need to expedite investments in sustainable technologies. In the following, the article will firstly examine the consideration given to climate protection concerns within the framework of state aid law. Subsequently, the Guidelines on State aid for climate, environmental protection and energy (?CEEAG?) 2022 and the GBER amendment 2023 will be analysed to determine how the European Commission's exemption practice is to be assessed with regard to an excessive transfer of risk to the Member States and with regard to the general prohibition of state aid under EU law.
