Die Rolle von Biodiversitätsstrategien
The primary objective of the CBD is the conservation of biological diversity In-situ. States are further away from achieving this goal than ever before. In the follow-up process to the CBD, resolutions of the Contracting States as well as European and National Biodiversity Strategies should play a central, integrative role. However, the instrumental and administrative integration of the visions, goals and targets can only be achieved by the sovereign states, even if the provisions of secondary EU law, especially the Habitats Directive, provide a basis for the ecosystem protection of European habitats and species. The terrestrial and marine areas in the Member States must be planned including biodiversity by way of urgent action in accordance with the Global Biodiversity Framework by 2030. At least 30 % of them must be effectively protected and well-connected, with 10 % of this being placed under strict protection. The GBF specifies Article 8 of the CBD in this respect. The restoration of degraded ecosystems must in future be carried out through the EU Restoration Law. A review and comparison with the current situation show that the conservation of biodiversity as a cross-cutting task has not progressed in the legal policy discourse since 2003. The National Biodiversity Strategy 2030 is by no means sufficient to raise the conservation of biodiversity as a key objective of the state task under Article 20a Basic Law to an appropriate level.
