Die neue Abfallverbringungsverordnung – ein Leitfaden

The new Regulation on waste shipments brings significant changes both for waste on the "Green List" and for waste for which a notification is required. Of particular note is the new auditing obligation, which applies to all waste shipments.

With regard to the regulation of "green list" waste in particular, the new legal definition of the party responsible for the shipment should also be mentioned. Furthermore, the shipment of green-listed waste to non-OECD countries is regulated more strictly, in particular through the new list of countries and the extension of the prohibition provisions, which now also include POP-contaminated waste, for example. At the level of waste for which a notification is required, the new Regulation on waste shipments also extends the scope of waste types subject to notification to include POP-contaminated waste, for example; mixed municipal waste that has already been treated is now addressed and highlighted. The European legislator also modifies the requirements for the notifiers themselves, incorporating the notification and authorization obligations of the Member States, and thus flanks the registration requirement in certain cases. For the notification procedure, the new regulation contains various changes to the structure and procedure of the notification, with regard to the documents to be provided and with regard to the subsequent amendment of the notification. The regulation also contains an initiative to set up a central information system for the electronic transmission of information, and the penalty regulations have been tightened and specified.
