Auswirkungen ökologischer Erkenntnisdefizite auf die verwaltungsgerichtliche Kontrolle

Zum Beschluss des Bundesverfassungsgerichts vom 23.10.2018 – 1 BvR 2523/13, 1 BvR 595/14

Administrative courts applying ecological standards in the context of environmental legislation held that the administration should dispose of an assessment power in its own right in cases the current ecological knowledge is doubtful and cannot be provided by experts. The assessment would be reviewed only in the sense of being justifiable. The Federal Constitutional Court did not accept this concept. It preferred a simple and de facto restriction of the judicial review if a vacuum of knowledge should occur.
