Rechtsfragen der Zwischenlagerung von hochradioaktiven wärmeentwickelnden Abfällen
This article deals with the fact that the final disposal process for highly radioactive waste will be delayed way beyond the envisaged date of 2031. It will take several decades more to store this waste in the 16 interim storage facilities.
In addition, the authorization process is uncertain. The Atomic Energy Act (AtG) does not provide a clear legal basis. The author is in favor of applying for new licenses for the storage containers. And a change of the existing storage licenses would also be conceivable. In view of the possible obligation to carry out an environmental impact assessment this decision is of central importance. Furthermore, regulatory powers play a decisive role. They should intervene in the event of a storage license being refused in order to avoid situations without a permit. A new participatory model along the lines of the Site Selection Act (StandAG) is not necessary. In view of the extended storage the existing possibilities under the current procedural regulations should be fully used first.
