Die Stellung der Lieferketten-Richtlinie im europarechtlichen Kontext

This article deals with the EU primary law context of the Corporate Sustainability Due Diligence Directive (CSDDD). The article primarily examines the adoption of the CSDDD on the legal basis for the implementation of the internal market (Art. 50 and Art. 114 TFEU) and asks whether the primary regulatory objective of the CSDDD is not rather located in the area of human rights and environmental law. Furthermore, the degree of harmonization and the associated remaining scope for the implementation of the directive, particularly for thoseMember States that already have supply chain regulations, are examined. Finally, the article deals with the question of the choice of the form of the legal act and attempts to show the significance of the form of the regulation as a directive as compared to a regulation.
