Umweltrechtswissenschaft im Wandel

Von der Etablierung zur Ausdifferenzierung

Legislative and political codification and institutionalisation provided the impetus for the establishment of environmental law. However, it was precisely institutional structures that consolidated the field of law and thus also the jurisprudential approach. These structures can be divided into literary, university and corporate structures, which gave environmental law flexible and stable foundations. In some cases, however, cracks can be seen in these foundations – but due to the further development and differentiation of environmental law, these gaps are either being closed or replaced by (necessary) specialisations, e.g. in climate change law. In the tension between stability and flexibility, environmental law is ultimately well equipped to deal with future upheavals.
