Die Bedeutung der Neufassung des Umweltrechtsbehelfsgesetzes vom 29. Mai 2017 für das Raumplanungs- und Baurecht
Mit dem Gesetz zur Anpassung des Umweltrechtsbehelfsgesetzes und anderer Vorschriften an europa- und völkerrechtliche Vorgaben vom 29.5.2017 versucht der Gesetzgeber zum nun mehr dritten Mal, der völker- und unionsrechtlichen Verpflichtung der Bundesrepublik Deutschland nachzukommen, einen effektiven Rechtsschutz in Umweltangelegenheiten sicherzustellen.
Oncemore, the German legislator had to pass a bill to complywith International and European requirements concerning access to justice in environmental matters forced by judgements of the European Court of Justice and a Decision of the FifthMeeting of the Parties of the Aarhus Convention. The article presents, explains and evaluates the legal adaptations focusing on regional and urban planning law.
