The FuelEU Maritime Regulation, which aims to reduce greenhouse gas emissions from shipping, operates with certain regulatory structures that have so far only appeared in emissions trading law: It gives the addressees a certain amount of leeway to define the obligations that stem from the regulation and ultimately also enables the establishment of a market for conformity balances for ships similar to the emissions certificate market. In addition, it relies primarily on sanction-like payment obligations in the event of non-compliancewith the regulation and only as a last resort on operating bans. Finally, it installsacomplexdocumentationsystemwithreportingobligations for shippingcompanies. The conclusion that can be drawn from this is that these regulatory structures, which were until now typical for emissions trading law, are increasingly becoming typical patterns of (environmental) regulatory law in general while being reshaped by EU law.
