Gleichwertigkeit der Lebensverhältnisse durch Raumordnung?
The equivalence of living conditions, which is the aim of the guiding principle of sustainable spatial development (Section 1 (2) ROG), is still of central importance for spatial planning today. It is substantiated by principles of spatial planning and is implemented in particular in the spatial planning plans. Equal living conditions are to be interpreted in a way that is specific to spatial planning. Constitutional and European law only play a subordinate role in this context. In order to be effective, there is an urgent need for a contemporary development of their understanding and the instruments implementing them.
Die Gleichwertigkeit der Lebensverhältnisse, auf welche die Leitvorstellung der nachhaltigen Raumentwicklung (§ 1 Abs. 2 ROG) abzielt, hat bis heute eine zentrale Bedeutung für die Raumordnung. Sie wird durch Grundsätze der Raumordnung konkretisiert und insbesondere in den Raumordnungsplänen umgesetzt. Gleichwertige Lebensverhältnisse sind raumordnungsspezifisch auszulegen. Verfassungs- und Europarecht spielen dabei eine nur untergeordnete Rolle. Für ihre Wirksamkeit bedarf es dringend einer zeitgemäßen Weiterentwicklung ihres Verständnisses und des sie umsetzenden Instrumentariums.
